Acceptable Use Policy

The acceptable use policy is a set of rules that restricts the ways in which our website, network and system may be used and sets guidelines as to how it should be used.

This Acceptable Use Policy (“AUP” or “Policy”) of i3D.net B.V, and its affiliates, (“i3D.net”, “we”, “our” or “us”) is designed to provide a clear understanding of the rules, regulations, and restrictions on the use of the Services, Servers, and IP Addresses of i3D.net (collectively, the “Services”). i3D.net may, from time to time and at the sole discretion of i3D.net, impose rules, regulations, or restrictions not expressly stated in this AUP. It is Client’s obligation to maintain and enforce these provisions against all of Client’s Sub-users, to maintain its own abuse/postmaster email addresses for reporting abuses and to promptly and appropriately respond to all emails sent to these addresses.

Prohibited Activities
You are prohibited from using i3D.net’s Services, directly or indirectly, for any of the following activities:

1. Illegal Activities
Engaging in any activity that violates local, state, national, or international laws and regulations, including:

  • Fraud/Fraudulent Activity
    Furtherance of or involving any fraudulent activity or fraudulent purpose, or to make any fraudulent offers to sell or buy products, items or services, or to advance any type of financial scam including, but not limited to, pyramid schemes, chain letters or any other financial scam; using i3D.net’s services to effect a misrepresentation or misleading statement, writing or activity.

  • Forgery or Impersonation (Phishing)
    Adding, removing, modifying, or forging any message header, network header, TCP/IP packet-header or any part of any header or information in any transmission, originating or passing through i3D.net services, in an effort to deceive or mislead another; impersonating or attempting to impersonate any person or entity in any transmission originating or passing through i3D.net’s services. Misleading or attempting to mislead any person or entity by use of incorrect identifying information.

  • Harm to Minors/Child Pornography
    Harming minors in any way or transmitting or storing on a server any child pornography as defined by applicable law.

2. Malicious Activities
Initiating, transmitting, or facilitating any form of malicious software, malware, viruses, ransomware, or other harmful code; or effect the intentional distribution of software or computer code, files or programs that causes, or attempts to cause, damage, harassment or annoyance to persons, entities, data and/or computer systems.

3. Unauthorized Access (Cracking/Hacking)
Accessing, corrupting or taking, or attempting to access, corrupt or take, any data, information or the accounts of others; logging into a server or account, or entering or using or attempting to enter or use another person’s or entity’s computer system which Client/Client’s Sub-User is not authorized to access, enter or use; penetrating or attempting to penetrate i3D.net security-measures or another person’s or entity’s computer software or hardware, electronic communications system, or telecommunications system or security; and any similar activity prohibited by law; Using i3D.net’s services to transmit or store on a server any information, data, content, material or work that infringes any copyright, trademark, service mark, patent, trade secret any or other intellectual property right(s) of any person or entity.

4. Harassment and Threats
Engaging in any form of online harassment (such as cyberbullying, hate speech, or making threats); or transmit or the storing on a server any material that abuses, threatens, or encourages bodily harm, destruction of property or any other type of harm or any material in violation of any duty under any law (including court order), contract or any fiduciary relationship.

5. Data Breaches
Unauthorized attempt to access, exfiltrate, or disclose sensitive data, including customer data.

6. Intellectual Property Violations
Transmit or store on a server any information, data, content, material, or work that infringes any copyright, trademark, service mark, patent, trade secret any or other intellectual property right(s) of any person or entity.

7. Network Abuse
Interfering with, disrupting or adversely affecting, or attempting to interfere with, disrupt or adversely affect, the ability to use i3D.net’s services, the Internet or any other services or equipment (this includes Denial-of-Service attacks against another network, host or individual user); using i3D.net’s services to interfere with, disrupt or adversely affect, or to attempt to interfere with, disrupt or adversely affect, the service of any Client, Client’s sub-users, host, network or system, including, without limitation, via means of overloading, flooding, email bombing, news bombing, crashing or any similar activity; using i3D.net services to impede another person’s use of electronic mail services or news; using any program, or sending messages of any kind, designed to interfere with or disable a user’s session.

Fair Use
In addition to the above prohibitions, i3D.net enforces Fair Use to ensure fair and equal access to our Services for all Clients. Excessive and unreasonable use of network resources may result in action, including throttling or suspension of service. The Fair Use Policy promotes responsible and equitable resource utilization.

More specifically, we ensure that our Clients comply by assessing their average monthly bandwidth usage over a twelve-month period. Should the usage of our Services exceed the typical patterns for game hosting or deviate from the customary behavior of our Clients, it may be categorized as excessive and/or unreasonable.
Our Fair Use Policy delineates specific bandwidth allocations; aggregated per geographical location:

  • 20 Terabytes (TB) per server in North America and Europe;
  • 5TB per server in APAC (excluding Mumbai); and
  • 2TB per server in MEA, LATAM regions and Mumbai.

If your usage is flagged as excessive and/or unreasonable, we may contact you to discuss a potential breach. Subsequently, we may request your collaboration in adjusting your game hosting accordingly. Should excessive and/or unreasonable usage persist following the adjustment, we may assess charges on your account without prior notification. We reserve the right to suspend, modify or restrict the use of game hosting services in case of policy breaches.

Zero Spam
I3D.net is committed to combatting and maintaining a clean email environment, and we prohibit the use of our Services for spam-related activities. Engaging in activities that contravene the CAN-SPAM Act of 2003 or ay other legislation governing email services constitutes a breach of this AUP. Should a Client host websites or services on their server that support spammers or result in the inclusion of i3D.net’s IP addresses in spam databases (such as SpamHaus) or black hole lists, their Service will be promptly disconnected following a 24 hour warning period. We do allow our Client to repair the violation before service suspension will be in effect. If the listing database incurs a de-listing fee, the costs (starting at a flat fee of EUR100.00) will be charged to the Client.

Disclosure to Law Enforcement
Occasionally, i3D.net is required by law to submit customer information to law enforcement officials when presented with a valid subpoena from a court with proper jurisdiction. Information requested is disclosed as directed pursuant to the subpoena. i3D.net utilizes great care in keeping customer information safe and private and will only release information described in the subpoena. i3D.net will notify customer of the information request if allowed by the subpoena. Please consult an attorney if you are uncertain of the legal status of any of your activities.

Reporting Violations
If you believe that someone is using i3D.net’s Services in violation of this AUP, please report it to our abuse team at abuse@i3D.net. Reports of alleged violations must be verified and include name, contact information, IP address, and description of the violation. We take all reports seriously and will investigate promptly.

Consequences of Breach
Failure to comply with this AUP may result in one or more of the following actions, at i3D.net’s sole discretion:

  • A formal warning regarding the violation and potential consequences;
  • Temporary suspension of services pending investigation;
  • Termination of services for serious or repeated violations; and/or
  • Disclosure of information to law enforcement agencies and/or any legal action against Client for breach of this Policy, including but not limited to claiming all costs, fees, and disbursements (including but not limited to legal fees) connected therewith.

To prevent abuse, we may ask you to identify yourself appropriately. In case of access to personal data linked to a cookie, you must send a copy of the cookie in question. You can find them in the settings of your browser.

Changes to this Acceptable Use Policy
i3D.net may update this Acceptable Use Policy from time to time in response to changing legal, technical, or business developments. The most recent version will be posted on our website, and such modification shall become immediately effective upon posting. The date of the last update will be indicated at the beginning of the statement.
